Terms of Service

Welcome to SocialFlare. These Terms of Service ("Terms") govern your access to and use of the SocialFlare website, mobile application, and related services (together, the "Platform"), operated by SocialFlare ("SocialFlare," "we," "us," or "our"), based in California, United States. By creating an account or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use SocialFlare.

1. Eligibility

You must be at least 13 years old to create a SocialFlare account.

If you are between 13 and 17 years old, you may only use SocialFlare with the consent of a parent or legal guardian, and certain features are restricted (see below).

You must be at least 18 years old to:

  • Go live / stream on the Platform
  • Send or receive virtual gifts
  • Access creator earnings, payouts, or any monetization features

We may ask you to verify your age or identity before enabling any of the above features, and we may suspend access to them if we have reason to believe you do not meet these requirements.

2. Your Account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Please notify us immediately at socialflarexp@gmail.com if you suspect unauthorized use of your account.

3. Your Content and License to SocialFlare

You own the videos, photos, comments, and other content you create and upload to SocialFlare ("Your Content"). We do not claim ownership of Your Content.

By posting Your Content on SocialFlare, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, distribute, display, and perform Your Content solely for the purpose of operating, promoting, and improving the Platform (for example, showing your videos in feeds, search results, or recommendations to other users). This license ends when you delete Your Content or your account, except where copies have been shared by other users or are needed to comply with legal obligations.

You are solely responsible for ensuring you have the rights necessary to post Your Content.

4. Prohibited Content and Conduct

You may not use SocialFlare to post, send, or engage in any of the following:

  • Harassment, bullying, threats, or targeted abuse of any person or group
  • Hate speech, or content that attacks people based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics
  • Nudity, sexually explicit content, or sexual content involving minors (which will be reported to relevant authorities)
  • Violence, graphic content, or content that promotes or incites violence
  • Content that infringes copyright, trademark, or other intellectual property rights
  • Spam, scams, fraud, or deceptive impersonation of another person or brand
  • Any activity that is illegal under applicable law

5. Suspension and Termination

SocialFlare reserves the right to remove content, and to suspend or terminate any account, at our discretion, if we believe a user has violated these Terms, our Community Guidelines, or applicable law. We will make reasonable efforts to notify you of enforcement action, but may act immediately without notice where necessary to protect the safety of our community or the integrity of the Platform.

6. Earnings and Payouts

Eligible creators (18 years or older) may be able to earn money through virtual gifts, creator funds, or other monetization features offered on the Platform. All earnings, payout schedules, minimum thresholds, fees, and eligibility requirements are subject to SocialFlare's payment policies, which may be updated from time to time. SocialFlare may withhold or reverse payouts associated with fraudulent activity, chargebacks, or violations of these Terms.

7. Disclaimers and Limitation of Liability

SocialFlare is provided "as is" without warranties of any kind. To the fullest extent permitted by law, SocialFlare will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

8. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Platform or by email. Continued use of SocialFlare after changes take effect means you accept the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of SocialFlare will be subject to the exclusive jurisdiction of the state and federal courts located in California.
